Frank Addario Comments on Upcoming Supreme Court Case on Jordan Ceiling

Frank Addario was interviewed by the Globe and Mail about an upcoming case at the Supreme Court of Canada, R. v. Vrbanic. In Vrbanic, the Crown and many attorneys general are asking the Supreme Court to revisit its 2016 decision in R. v. Jordan to relax the framework for assessing delay. Frank spoke out against these attempts at rolling back the protections from Jordan. Instead of improving the justice system, he told the Globe, the state is seeking reprieve at the Supreme Court from their constitutional obligations to the accused. Frank said there is no evidence that Jordan is unworkable and that the blame for stays of proceedings should fall on the Crown for failing to bring accused people to trial in a reasonable time, as required by the Charter. As Frank put it, "you want to water down a constitutional right because you're not complying with it?"

Vrbanic will be heard by the Supreme Court on Thursday December 4th. Frank and Nikolas De Stefano are intervening on behalf of the Criminal Lawyer's Association.
